1.     ABOUT BERGL DIAMONDS

1.1.

These rules for handling personal data have been adopted by the company DOLCZE traditional manufacturing s.r.o., Identification Number (IČO): 01451596, with its registered office at Klimentská 1974/20, Nové Město, 110 00 Prague 1, registered in the commercial register under file number C 206604 maintained by the Municipal Court in Prague (hereinafter referred to as "BERGL DIAMONDS").

1.2.

These rules govern the practices of BERGL DIAMONDS, especially concerning the operation of the website www.bergldiamonds.cz (hereinafter referred to as the "website") in relation to its users and communication with its customers or suppliers. BERGL DIAMONDS acts as the data controller when processing personal data.

2.     WHAT DATA DO WE PROCESS?

2.1.

The personal data we process are either provided directly by you when communicating with BERGL DIAMONDS or on the website. Some personal data may also be collected by BERGL DIAMONDS itself when monitoring user behavior on the website or by associating additional personal data, such as age, gender, shopping behavior, or information about your financial institution, with personal data.

Identification and contact details, including your name, surname, billing or delivery address, Identification Number (IČO), Tax Identification Number (DIČ), and phone number. In the case of website registration, these details may include a username and password. These details allow us to clearly associate an order or other request with your person and contact you.

2.3.

Settings and preferences, including your newsletter subscription preferences, cookie settings, participation in contests or surveys.

2.4.

Order details and other requests, including information about purchased goods, your specific order details such as product delivery, specific requirements, or complaints, and payment information.

2.5.

Web behavior data, including information about viewed products and selections, information about the device, system or browser used, IP address, and, if applicable, derived location information, including data obtained from cookie usage.

2.6.

Data related to behavior when viewing newsletters and other messages, including the time of reading, the device used, and any selections made.

2.7.

Information provided when using our contact forms on the website and during phone or other communication with BERGL DIAMONDS.

3.     HOW DO WE USE PERSONAL DATA?

3.1.

BERGL DIAMONDS uses your personal data only for the purposes for which they were collected, based on your consent or other legal grounds.

3.2. Order Processing

Identification, contact, and payment details are typically used for processing orders from BERGL DIAMONDS' suppliers or processing orders for BERGL DIAMONDS' customers. Additional processed data may include your preferences, comments, or information related to product complaints. In this case, personal data is processed as part of fulfilling a contract or based on BERGL DIAMONDS' legitimate interest when processing the personal data of legal entities' representatives. Personal data is used primarily for order creation, order processing, goods delivery, payment processing, and settling other obligations between BERGL DIAMONDS and its customer or supplier. Personal data may also be used for communication related to a given order. Providing personal data is necessary for the proper processing of an order. Personal data is processed for the period necessary to complete the order and for an additional 5 years or longer, until the resolution of any claims related to BERGL DIAMONDS.

3.3. Registration and Profile Management

If you want to register for the partner section of the website at www.bergldiamonds/diamondsclub, you will be asked to provide your name, surname, address, and email address. Subsequently, you will be given access to your profile through a username and password. Data processing in this case is based on your request for access to the partner section, as part of the contract formed when creating your profile. No consent is required for this processing. In connection with profile management, you may also receive email or other communications that are not commercial messages. A profile cannot be created without providing personal data.

For this purpose, BERGL DIAMONDS processes personal data for the duration of the profile's existence, which can be deleted at any time upon your request.

3.4. Marketing – Newsletter, Contests, and Surveys

PFor sending newsletters, BERGL DIAMONDS uses your email address, which you enter in the relevant field on the website, where you express your interest in subscribing and subsequently confirm it from the sent email. This action simultaneously grants consent to process personal data. Consent is voluntary, and its withdrawal does not restrict the use of other website features. You can revoke your consent at any time by clicking the unsubscribe link in the footer of each newsletter sent or by using the contact information provided in these rules.

Processing takes place only for the duration of your consent. To ensure that the newsletter remains relevant to you, BERGL DIAMONDS verifies your interest in receiving it every 5 years.

For announced contests and conducting marketing surveys, BERGL DIAMONDS processes personal data only for those individuals who voluntarily express interest in participating and provide consent to the processing of identification and contact details they enter when registering for the contest.

Processing is possible only for the duration of your consent or until the contest and marketing survey are evaluated.

3.5. Marketing – Offering Related Products

In the case of current or former customers, BERGL DIAMONDS, based on its legitimate interest, may send commercial messages related to products you have previously ordered or purchased from BERGL DIAMONDS. You can opt out of receiving these commercial messages at any time by clicking the unsubscribe link in the footer of each such email or by objecting to such processing through the contacts provided in these rules.

Personal data processing continues for a maximum of 5 years from the end of the business relationship between the customer and BERGL DIAMONDS, typically from the moment of full payment for the product.

3.6. Marketing – Customer References

Based on a special agreement between you and BERGL DIAMONDS, information about your experiences with BERGL DIAMONDS' products, including your comments or photographs of BERGL DIAMONDS' products, may be published with your consent. The exact scope of published information and other conditions are agreed upon individually with BERGL DIAMONDS. Information may be published on BERGL DIAMONDS' website, BERGL DIAMONDS' social media profiles, or other media.

Processing of personal data contained in references continues only until you withdraw your consent or for the duration of the publication of your reference. Your consent to processing can be withdrawn at any time.

3.7. Fulfillment of Legal Obligations

BERGL DIAMONDS is required to process personal data in some cases to fulfill its legal obligations, for example, when processing invoices for a period of 10 years. Such processing is done without your consent.

Nad rámec uvedených účelů a dob může BERGL DIAMONDS zpracovávat osobní údaje pouze v souladu s právními předpisy, například pro účely svých oprávněných zájmů nebo pro splnění zákonem stanovené povinnosti zejména v rámci účetních nebo daňových předpisů.    

4. WHO HAS ACCESS TO PERSONAL DATA?

These include, for example, third parties that provide email marketing services, delivery services, payment gateways, marketing survey services, website operators, software and technical solution providers, including their subcontractors.
